Capital Case Mitigation (Sentencing): When a defendant is facing capital charges and the possibility of a death sentence, thorough and comprehensive mitigation investigation is essential. Developing a biopsychosocial history will help the defense team paint a picture of their client’s humanity and aid in proper advocacy for their life. Having an experienced Mitigation Specialist is fundamental to assisting the defense team with conducting witness interviews and records retrieval, developing demonstrative exhibits at trial, identifying and consulting with potential mental health experts and other professionals, and much more. Mr. Dworkin has worked with capital defendants of all ages, races, and ethnicities. His mitigation investigations have taken him throughout the country, and he has experience working with foreign governments and conducting mitigation investigation in countries abroad. He has served on numerous capital case appointments over the years; notably to the defense team of a high value detainee at Guantanamo Bay, Cuba (Military Commissions Proceedings), as well as other high profile capital cases in Virginia, Kentucky, Tennessee, and other states.

Sam has extensive experience conducting sentencing advocacy in non-capital criminal cases across a variety of criminal charges, both in state and federal courts as well. He has attended training for, and assisted with the, re-sentencings of juveniles convicted of Life Without Parole (resulting from the Miller v. Alabama decision)

Case Investigation: Sam Dworkin conducts investigations for Pretrial Criminal cases, Habeas proceedings, Post-Conviction, Civil cases, and Private cases as well. Conducting evidence and scene reviews, interviewing witnesses and statement taking, assisting in juror voir dire and post verdict juror interviews, assisting with and formulating investigative strategy, surveillance, and other tasks are all part of Mr. Dworkin’s purview.

Process Service and Court Filing: Serving subpoenas and notices, and filing such with the courts are also available services offered.
